If you ever hear a Supreme Court oral argument then you will know very few "real" questions are asked of counsel. Often a Justice will ask a question to establish a launching pad for his or her theory of the case. Indeed, oral argument often devolves into the Justices trying to convince the other one to their side. It can often become a really bad McLaughlin Group show- sad to say.
